Mentari Terms of Service

IMPORTANT – PLEASE READ CAREFULLY
BY TAPPING "I ACCEPT," OR BY DOWNLOADING, INSTALLING, ACCESSING OR USING THE MENTARI MOBILE APP OR ANY RELATED WEBSITE, DASHBOARD, API, OR SERVICE (COLLECTIVELY, the "Service"), YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE ("Terms"). If you do not agree, do not use the Service. These Terms form a binding contract between you and Tailored Tales, LLC ("Tailored Tales," "Mentari," "we," "our," or "us").
Arbitration & Class-Action Waiver
Except for certain disputes described in §17, ANY DISPUTE BETWEEN YOU AND US WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION—NOT IN COURT—AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION. See §17 for details.
1. Service Overview
Mentari provides an AI-enabled companion for children that:
- creates a one-time personalized cartoon avatar from a single parent-supplied photo (the original photo is permanently deleted after avatar creation);
- engages children in educational, social-emotional, and creative conversations;
- records conversation transcripts and extracts "memories" to maintain context;
- Creates fun and educational visual and auditory lessons
- supplies parents with full transcript access, daily conversation summaries, topic-flag alerts, and content-filter controls.
The Service is intended solely for informational, educational, and recreational purposes. It is not a substitute for professional medical, psychological, legal, or educational advice. IN CASE OF EMERGENCY DIAL 911.
2. Eligibility & Parental Responsibilities
Parental Account. The Service may only be activated by a parent or legal guardian ("Parent") who is at least 18 years old.
Child Users. A child under 16 ("Child") may interact with Mentari only through a Parent-approved account, under the Parent's supervision.
COPPA Compliance. We collect only the minimum personal data required for parental consent and to operate the Service, in compliance with the U.S. Children's Online Privacy Protection Act (COPPA).
Parental Controls. Parents must:
- maintain account credentials securely,
- review transcripts and flagged content,
- configure avoid topics and other settings, and
- ensure the Child's use complies with these Terms.
Parents are fully responsible for the Child's activities within the Service.
3. Accounts & Registration
You must provide accurate, current information and keep it updated. You are responsible for all activity under your credentials. Notify us immediately at [email protected] if you suspect unauthorized access.
4. Payment & Subscriptions (if applicable)
Certain features may require payment of fees (e.g., weekly or annual subscriptions purchased through the Apple App Store or Google Play).
Pricing & Auto-Renewal. The Service will clearly disclose subscription price, billing cycle, and renewal terms before purchase.
Cancellation. You may cancel at any time through your app-store account settings; cancellation takes effect at the end of the current billing period.
Refunds. Except where required by law, payments are non-refundable. App-store rules may govern additional rights.
5. License Grant & Restrictions
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use one copy of the Mentari app on a device you own or control solely for lawful, non-commercial use. You may not (a) copy, modify, or distribute the Service; (b) reverse-engineer or attempt to extract source code; (c) use output to train competing AI models; or (d) infringe any third-party rights.
6. User Content
Inputs & Outputs. Text, audio, images, or other content you or the Child submit are "Inputs." AI-generated responses are "Outputs."
Ownership. As between you and Tailored Tales, you own all lawful rights in Inputs and Outputs. You grant us a worldwide, royalty-free license to store, process, and use Inputs and Outputs solely to operate, maintain, and improve the Service (including model refinement).
Prohibited Inputs. Do not upload content that is illegal, harassing, hateful, sexual, or otherwise violates §10.

We never sell or share personal data or transcripts with third parties, and we do not use data for targeted advertising. For full details, see the Mentari Privacy Policy.
8. Informational Use & Disclaimers
Outputs are generated by probabilistic AI models and may be inaccurate, incomplete, or inappropriate. You rely on them at your own risk. Mentari does not diagnose, treat, or provide professional advice.
9. Messaging & Notifications
By creating an account, you consent to receive push notifications and, if you opt in, SMS or email messages regarding account activity, daily summaries, and Service updates. You may disable non-essential notifications in the app-settings.
10. Prohibited Conduct
You and the Child must not:
- Violate any law or third-party right.
- Upload personal data of others without consent.
- Attempt to interfere with or reverse-engineer the Service.
- Use the Service to generate or distribute disallowed content, including but not limited to:
- sexually explicit material;
- violent or self-harm instructions;
- hate speech or harassment;
- personal data of minors beyond what Mentari requests for avatar creation.
Violation may result in immediate suspension or termination.
11. Third-Party Services
Mentari may link to, or rely on, third-party services (e.g., app stores, cloud hosting). We are not responsible for those services' content or practices.
12. Modification of Terms or Service
We may modify these Terms or the Service. Material changes will take effect 30 days after we post notice (or as required by law). If you disagree, discontinue use before the effective date.
13. Suspension & Termination
We may suspend or terminate access at any time for violation of these Terms or to protect the Service or its users. You may terminate your account at any time via in-app settings or by emailing support. Sections that by their nature should survive (e.g., licenses, disclaimers, arbitration) will survive termination.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Tailored Tales, its affiliates, officers, and employees from any claim or liability arising out of: (a) your or the Child's misuse of the Service; (b) violation of these Terms; or (c) infringement of third-party rights.
15. Disclaimers; No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TAILORED TALES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ERROR-FREE OPERATION. We do not warrant that the Service will be uninterrupted or secure.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILORED TALES SHALL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY AMOUNT EXCEEDING US$100 IN THE AGGREGATE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.
17. Dispute Resolution & Arbitration
Informal Resolution. Contact us at [email protected]; we will attempt to resolve disputes informally within 30 days.
Binding Arbitration. If unresolved, any claim will be settled by confidential, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules in [County, State].
No Class Actions. Claims must be brought individually; class or representative proceedings are not permitted.
Opt-Out. You may opt out of arbitration by sending a written notice to the address in §21 within 30 days of first agreeing to these Terms.
18. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs §17.
19. International Use
The Service is intended for users in the United States. Access from other jurisdictions is at your own risk and you are responsible for compliance with local laws.

22. Apple iOS Special Terms
The following apply if you access the Service via the Apple App Store:
- Apple is not a party to these Terms.
- In the event of any failure of the app to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
23. Miscellaneous
These Terms constitute the entire agreement between you and Tailored Tales regarding the Service and supersede all prior agreements. If any provision is held unenforceable, the remaining provisions will remain in effect. Tailored Tales may assign these Terms without restriction; you may not assign them without our prior written consent. All headings are for convenience only.
